2. Proposed Decision
The Colorado Division of Reclamation, Mining and Safety proposes to approve this Application
for renewal of a valid existing permit. This decision is based on a finding that the operations will
comply with all requirements of the Colorado State Program as found in the Colorado Surface
Coal Mining Reclamation Act, Colorado Revised Statutes 34-33-101 et seq., and the Regulations
promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30)
days of the first publication of the issuance of this proposed decision, then this decision becomes
final. Acceptable surety has been submitted by the applicant. The Application, all supporting
documentation and any stipulations or conditions will become a binding part of the Permit.
3. Summary
3.1 The Review Process
3.1.1 Initiation of Renewal
The Division of Reclamation, Mining and Safety (Division) notified the Coors Energy Company
(CEC) on January 31, 2006, that the existing Permit for the Keenesburg Mine would expire on
November 3, 2006. CEC responded on May 2, 2006 with an application for permit renewal. The
Division deemed the Application complete on May 5, 2006.
3.1.2 Public Notice
Public notice of submittal of the Application was published, by the CEC, in The South Weld Sun
on May 25, 2006. Notice that the Application was considered complete for the purposes of filing
was provided by the Division, in accordance with Title 34, Article 33, Section 118, Paragraph 3,
of the Colorado Revised Statutes.
3.1.3 Application Reviews and Responses
The Application was reviewed for adequacy. The Division identified items requiring update or
additional adequacy concerns in a letter to CEC, dated July 27, 2006. CEC provided acceptable
responses to six adequacy items on September 13, 2006. Two items remained unresolved. The
Division sent a second adequacy letter to CEC on September 29, 2006 requesting additional
information to resolve the remaining adequacy items. CEC submitted responses to this second
adequacy letter on October 17, 2006. The remaining adequacy concerns were resolved
satisfactorily.
3.1.4 Status of Permit Stipulations
There aze no stipulations on this permit at this time. Stipulations 1 through 4, 6 through 16, and
18 of the original permit were resolved during the first five-yeaz permit term. Stipulations 19, 22
and 27 were resolved during the second five-yeaz permit term. (Findings, 1992) Stipulations 5,
17, 20, 21, 23, 24, 25, 26, 28, 29, 30, 31 were resolved during the third five-yeaz permit term.
