2. Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve this Application <br />for renewal of a valid existing permit. This decision is based on a finding that the operations will <br />comply with all requirements of the Colorado State Program as found in the Colorado Surface <br />Coal Mining Reclamation Act, Colorado Revised Statutes 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30) <br />days of the first publication of the issuance of this proposed decision, then this decision becomes <br />final. Acceptable surety has been submitted by the applicant. The Application, all supporting <br />documentation and any stipulations or conditions will become a binding part of the Permit. <br />3. Summary <br />3.1 The Review Process <br />3.1.1 Initiation of Renewal <br />The Division of Reclamation, Mining and Safety (Division) notified the Coors Energy Company <br />(CEC) on January 31, 2006, that the existing Permit for the Keenesburg Mine would expire on <br />November 3, 2006. CEC responded on May 2, 2006 with an application for permit renewal. The <br />Division deemed the Application complete on May 5, 2006. <br />3.1.2 Public Notice <br />Public notice of submittal of the Application was published, by the CEC, in The South Weld Sun <br />on May 25, 2006. Notice that the Application was considered complete for the purposes of filing <br />was provided by the Division, in accordance with Title 34, Article 33, Section 118, Paragraph 3, <br />of the Colorado Revised Statutes. <br />3.1.3 Application Reviews and Responses <br />The Application was reviewed for adequacy. The Division identified items requiring update or <br />additional adequacy concerns in a letter to CEC, dated July 27, 2006. CEC provided acceptable <br />responses to six adequacy items on September 13, 2006. Two items remained unresolved. The <br />Division sent a second adequacy letter to CEC on September 29, 2006 requesting additional <br />information to resolve the remaining adequacy items. CEC submitted responses to this second <br />adequacy letter on October 17, 2006. The remaining adequacy concerns were resolved <br />satisfactorily. <br />3.1.4 Status of Permit Stipulations <br />There aze no stipulations on this permit at this time. Stipulations 1 through 4, 6 through 16, and <br />18 of the original permit were resolved during the first five-yeaz permit term. Stipulations 19, 22 <br />and 27 were resolved during the second five-yeaz permit term.
