If mining commences they will mine in accordance with <br />CDMG Permits M-77-310 and M-77-284 and reclamation will proceed in accordance with these <br />permits. This EA for the BLM initiated 3809 Plan of Operations will include the mine waste <br />storage area, previously authorized under Right-of-Way (R/VJ) reservation (COC-23&34) to the <br />Department of Energy (DOE) and the two CDMG permits. The project area is la:ated in T.46N., <br />R.17W., Section 21 and 22, NMPM. The mining claims associated with this projr'ct are the <br />Mineral Joe No. 1-19. There are approximately 16 acres of surface disturbance ;associated with <br />this Plan. <br />The operator/claimant will continue to comply with 43 CFR 3815.2, 3715.2-1 and 3715.5. The <br />use or occupancy of the lands in the repoR area is limited to that which is reasonably incident to <br />mining operations. <br />II. Alternatives <br />A. Alternative 1 -Proposed Action -Approve the plan of operations subject to the <br />conditions attached below. No significant impacts will result because all the disturbed <br />areas will be reclaimed. All existing disturbance was completed prior to t'ae <br />requirements of the 3809 regulations. <br />B. Alternative 2 - No Action -Not an alternative for consideration. <br />III. Decision and Rationale <br />The decision is to approve the plan of operations subject to the conditions attached below. This <br />action will not result in any significant adverse impacts, conforms with the SJ(SM RMP and will <br />not cause unnecessary or undue degradation. <br />In addition, the decision is to close R/W case file, COC-23834, which reservation was issued to <br />DOE, and incorporate the waste rock dump area into this Plan of Operations to bra authorized to <br />Cotter Corporation. <br />The structures on the mining claims addressed in this EA are associated with this mining <br />operation and were used for mining purposes in the past and are reasonably incident to mining. <br />IV. MITIGATION. COMPLIANCE AND MONITORING <br />The following mitigation measures will be required to insure no significant impacts will occur. <br />For any new disturbances not within the footprint of the existing disturbances (except for <br />structures), a plan of operations amendment must be filed and approval gained tn>m this office. <br />The BLM will be notified of any changes to the mine permits through plan amendments and <br />when reclamation begins. <br />
