The DMG, as the secondary state agency in <br />this matter, will work with the WQCD, which is the primary state agency in this matter, in trying <br />to answer your concerns. I will forwazd a copy of your letter to Mr. Kubic. Also, I suggest you <br />keep in contact with Keith Lucy of the Delta County Health Department to see whatjurisdiction <br />they have in these matters. I will forwazd a copy of your letter to Mr. Lucy as well. <br />Your letter also states a concern for future erosion problems and other potential property damage <br />from the mine pond discharge. The DMG would be the state agency which has jurisdiction over <br />erosion problems and other physical damage that would be caused by mine site surface water <br />runoff. Downstream damage cannot be allowed. However, there is no evidence of such damage <br />at this time. The Division will review this situation and the potential for such damage during our <br />periodic inspections.
