Lochhead <br />1914 4365 Lane Exe~ulrve Dueaor <br />Michael B Long <br />Bowte, Colorado 81428 Division DireUOr <br />Re: Citizen Concern Letter, Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources Ltd. <br />Deaz Mr. Mitchell: <br />The Division of Minerals and Geology (DMG) received your letter on December 8, 1997, in <br />which you expressed your concern that the proposed dischazge of waste water from the Bowie <br />No. 2 Mine might adversely affect your health and livelihood. Because your letter describes <br />possible future problems, the DMG does not have sufficient basis to believe that a violation of <br />our regulations has occurred at this time. Therefore, the DMG will not be conducting a field <br />inspection based on your letter. However, the DMG will initiate a review of your situation in <br />order to determine if anything can be done, within olu jurisdiction, to alleviate any problems that <br />may arise in the future. Also, since the DMG conducts mine site inspections on a regulaz basis, <br />the opportunity to meet in the field with you to discuss your concerns, as we have done in the <br />past, is possible. <br />On November l9, 1997, the DMG met with you, Lee Bradley of Bowie Resources and Keith <br />Lucy of the Delta County Health Department at the Bowie No. 2 Mine and the Terror Creek <br />Loadout, in order to discuss the situation involving the Deer Trail Ditch and pond discharge from <br />the Bowie No. Z Mine. According to my information, an accord was eventually reached whereby <br />Bowie Resources agreed to construct a new segment of the Deer Trail Ditch that flows across the <br />Terror Creek Loadout land, parallel andjust to the west of the existing segment. According to the <br />consultant for the Terror Creek Loadout, Bowie Resources would maintain that segment of the <br />ditch. <br />At the present time, the Bowie No. 2 Mine has a Colorado Department of Public Health and <br />Environment (CDPHE) permit to discharge mine site surface runoff water from their <br />sedimentation ponds. The DMG understands that Bowie No. 2 has applied to the CDPHE for a <br />revision to their discharge permit, in order to discharge underground mine water and the treated <br />effluent from a sewage treatment plant out of their ponds as well. The CDPHE, and specifically <br />the Water Quality Control Division (WQCD), is the state agency which has jurisdiction over <br />water quality at point source discharge locations.
