There are two things we would like you to do, One, have the Division of
Mineral and Geology write a disclosure of their action and take full
responsibility of their action so we will not be liable in years to come as a
land owner, polluting the ground water, if this should happen People in
charge today that know about the incident move on with their careers and
all has been forgotten, especially after experiencing a mine inspection by
Erica Crosby and Carl Mount in September and their discovery of frivolous
violations. We can not afford to let this incident go unnoticed. Second,
over the next 5 years we would like water samples taken, if the buried
material are not removed. We do not have a water testing facility in our
immediate area.
In discussing this with our attorney, he advised us to immediately disclose
this to the Colorado Department of Health, Water Quality Control Division
and the Division of Wildlife attd let them decide if any action needs to be
taken.
After much discussion we decided to contact you and the Dept. ojMineral
and Geology. We know from our own experience how difficult this business
can be. We all have the best ententations to do a good job. Mistakes can
be made.
We received the paper workfrom the inspection of the Emma Enterprise I
and we appreciate the effort and time taken to correct the Diviston's
mistake. We hope in the future we ca» minimize this type of situation from
your. agency. We trust that you have taken time to write a letter of apology
to the D/atianal City Bank ofAuburn, Indiana. You have damaged my
creditability with the bankpresident.
Sineerefy,
~~
~~
James Vim Ella
Cc. Carl Mount
Cc. Erica Crosby
