Status: This stipulation was satisfied and terminated on27 September 1981. <br />Stipulation No. 12: WITHIN 60 DAYS OF APPROVAL OF THE MNG PERMIT, THE <br />APPLICANT MUST SUBMIT THE CALCULATIONS AND ASSUMPTIONS USED TO SIZE <br />THE RAILROAD LOOP SEDIMENTATION PONDS, AND MUST RESIZE THE OUTLET <br />CULVERT AS SEDIMENTATION PONDS AND MUST RESIZE THE OUTLET CULVERT <br />AS SEDIMENTATION POND NO.4 IN THE RAILROAD LOOP TO PREVENT EXCESSNE <br />PONDING AT THE ENTRANCE OR JUSTIFY THE PRESENT SIZING WITH <br />APPROPRIATE CALCULATIONS. THE LOWER SEGMENT OF THE SUBAREA R4 <br />REFUSE DITCH MUST ALSO BE RESIZED TO ACCOMMODATE THE 10 YEAR-24 <br />HOUR FLOW. <br />Status: This stipulation was satisfied and terminated on 27 September 1981. <br />Stipulation No. 13: THE APPLICANT SHALL SUBMIT TO THE REGULATORY <br />AUTHORITY WITHIN 90 DAYS A MODIFIED RESTORATION PLAN FOR SCULLION <br />GULCH TO OMIT THE 13 PROPOSED IN-CHANNEL ROCK CHECK DAMS. IN LIEU OF <br />THESE, THE APPLICANT SHALL INSTALL 3 DAMS OF SEDIMENT TRAPS, BUILT TO <br />SCS OR US FOREST SERVICE SPECIFICATIONS, AT THE DOWNSTREAM <br />CONSTRUCTION LIMITS IN SCULLION GULCH. THESE TRAPS SHOULD PROVIDE <br />SUFFICIENT STORAGE TO STORE ONE YEAR OF SEDIMENT ACCUMULATION FROM <br />D-PORTAL AREA. <br />Status: This stipulation was satisfied and terminated on 27 October 1981. <br />Stipulation No. 14: THE APPLICANT MUST PROVIDE THE REGULATORY <br />AUTHORITIES WITH PLANS TO RESIZE THE D-PORTAL AREA AND DP-1 PRINCIPAL <br />SPILLWAY TO ALLOW A MAXIMUM HEAD OF ONLY ONE FOOT ABOVE THE RISER <br />CREST OF PROVIDE ADDITIONAL FREEBOARD BETWEEN THE RISER CREST AND <br />EMERGENCY SPILLWAY CREST. THE REVISED PLAN SHOULD BE SUBMITTED <br />WITHIN 90 DAYS OF PERMIT APPROVAL. <br />Status: This stipulation was satisfied and terminated on 27 October 1981. <br />Stipulation No. 15: WITHIN 30 DAYS OF PERMIT APPROVAL, THE APPLICANT SHALL <br />COMMIT TO THE REGULATORY AUTHORITY TO COMPLY WITH THE FOLLOWING <br />REQUIREMENTS: TO IMPLEMENT SEDIMENT CONTROL MEASURES PRIOR TO THE <br />ONSET OF CONSTRUCTION OF THE COAL TRANSPORT AND STORAGE AREA; TO <br />PROVIDE EMERGENCY AND PRINCIPAL SPILLWAY OUTLETS WITH APPROPRIATE <br />EROSION CONTROL PRIOR TO THE CONSTRUCTION OF SEDIMENT PONDS; TO <br />PROVIDE BAFFLES ON EACH OF THE REFUSE DISPOSAL AREA SEDIMENT PONDS <br />AS NECESSARY. <br />Status: This stipulation was satisfied and terminated on 23 September 1981. <br />fi <br />
