Stipulation No. 1: I A PRIOR TO ISSUANCE OF A PERMIT TO CONDUCT MINING <br />OPERATIONS, THE MUST: SUBMIT A PERFORMANCE BOND PAYABLE TO THE <br />STATE AND THE US GOVERNMENT IN AN AMOUNT CONSISTENT WITH THE <br />REQUIREMENTS OF (B) BELOW AND THE RECLAMATION COST ESTIMATES <br />CONTAINED IN THE APPLICATION. <br />Status: This stipulation was satisfied and terminated on 27 July 1981. <br />Stipulation No. 2: UPON COMPLETION OF PRODUCTION MINING WITHIN THE <br />EASTERN MOST PORTION OF ROOM AND PILLAR PANEL R.P.I-D AND THE EASTER <br />HALF OF LONGWALL PANEL L.W.D-1, THE APPLICANT SHALL PREPARE ANALYSIS <br />OF THE SUBSIDENCE MONITORING DATA COLLECTED TO THAT DATE. NO <br />PRODUCTION MINING SHALL BE COMMENCED WITHIN ANY REGULATORY <br />AUTHORITY. <br />Status: This stipulation was satisfied and tenninated on 9 May 1986. <br />Stipulation No. 3: NO SUBAREA OF THE REFUSE DISPOSAL AREA SHALL BE <br />DISTURBED BY MINING ACTIVITIES UNTIL THE APPLICANT HAS DEMONSTRATED <br />TO THE REGULATORY AUTHORITIES SATISFACTION THAT SUFFICIENT NON- <br />TOXIC MATERIAL IS AVAILABLE TO COMPLY WITH RULE 4.10. <br />Status: This Stipulation was satisfied and terminated on 10 August 1981. <br />Stipulation No. 4: A PLAN MUST BE SUBMITTED TO THE REGULATORY AUTHORITY <br />WITHIN 30 DAYS OF APPROVAL OF THIS MINE PLAN FOR THE HANDLING AND <br />DISPOSAL OF MATERIAL IN THE "STORAGE AREA" AND APOST-MINING <br />TOPOGRAPHIC MAP OF THE RAILROAD STORAGE AND LOAD OUT AREAS. <br />Status: This stipulation was satisfied and terminated on 27 August 1981. <br />Stipulation No. 5: THE APPLICANT WILL INCORPORATE OVERBURDEN ANALYSIS <br />SUBMITTED TO THE REGULARY AUTHORITY ON MAY 29, 1981, INTO THE MINE <br />PLAN WITHIN 30 DAYS OF APPROVAL OF THE PERMIT. <br />Status: This stipulation was satisfied and terminated on 23 September 1981. <br />Stipulation No. 6: THE APPLICANT MUST SUBMIT A MONITORING PLAN FOR THE <br />WHITE RNER ALLUVIUM TO ENSURE THAT DRAWDOWN PROJECTIONS ARE NO <br />LARGE THAN ANTICIPATED AND THAT THE MONITORING OBJECTIVES OF <br />SECTION 4.24.5 OF THE COLORADO PERMANENT REGULATORY PROGRAM ARE <br />MET. THIS INFORMATION MUST BE SUBMITTED TO THE REGULATORY <br />AUTHORITY WITHIN 90 DAYS OF THE GRANTING OF THE PERMIT. <br />4 <br />
