Procedures and Summary Of The Review Process <br />Bond releases are initiated by a permittee of a coal mine in the form of an application. The <br />application requires a number of actions of the permittee, including public notice of submission <br />of the application. Upon receipt of an application, the Division reviews the application for <br />completeness. Subsequent to a determination that an application is complete, the Division <br />conducts an on-site inspection and evaluation of the reclaimed site. This inspection may occur <br />within thirty days of the application being found complete, weather permitting. Surface owners, <br />Office of Surface Mining (OSM), and other interested parties may participate in the inspection. <br />The Division considers information gained from the inspection, public and agency comments, <br />previous inspections, information presented in the application, and information within permit <br />files, and develops a Findings of Compliance document that summarizes the degree of <br />compliance with the rules associated with the release. Based on the Findings of Compliance, a <br />Proposed Decision is issued. The Proposed Decision is made available to the public and <br />interested agencies for 30 days. If uncontested, the proposed decision becomes final. If the <br />proposed decision is to-approve-the bond release, bonds-held by the Divisior may be returned of <br />reduced. If contested, a due process is engaged to determine the fate of the application. <br />This bond release (SLr05) was initiated by submission of a Minrec, Inc., North Thompson Creek <br />Mines Request for Final Bond Release Permit No. C-81-025, under a J. E. Stover Bc Associates <br />letter of Apri130, 2002 (Application). This Application was received at the Division on May 2, <br />2002. The Application was found incomplete on May 7, 2002. After shortcomings in the <br />application were corrected, the application was found complete on July 12, 2002. The Applicant <br />made public notice of the application, and provided proof of publication of a public notice <br />regazding the application, in the Glenwood Springs Post Independent. The notice was published <br />on June 11, 18, and 25, and July 2, 2002. The Applicant had also notified landowners within and <br />adjacent to the mine permit area and other interested parties of the application for bond release. <br />The Division received an expression of interest in response to notices by the Applicant from the <br />OSM.
