compliance with the equivalent Phase II criteria, an equivalent Phase II bond release was
approved for this area as well. An equivalent Phase II bond release is proposed in this decision
for the permanent Stoney Ridge Fan Shaft Road Bridge. As for Phase I, reclamation of the areas
of the four water-monitoring flume sites, the two water-monitoring piezometers, and removal of
signs and mazkers aze exempt from phased bond release liability periods; however, reclamation
bond is retained for the reclamation of these items, which could be eligible for a future final bond
release(s). Thus, under this proposed decision, the remaining 63.2 disturbed-area acres within the
current permit for the North Thompson Creek Mines and Loadout, including the 4.1-acre
Developed Water Resources azea, will have been granted Phase II bond release.
This proposed decision, SL-O5, proposes Phase III bond release for 58.9 acres of the remaining
63.2 disturbed-azea/affected-azea acres within the current Permit for the North Thompson Creek
Mines and Loadout. Under this proposed decision, reclamation bond is proposed to be retained
for removal of the mine water dischazge treatment systems in the 4.1-acre Developed Water
Resources postmining land use area, reclamation of 0.2 acres of four water-monitoring flume
bases and piezometers, and removal of Permit boundary identification signs and disturbed area
mazkers. The Division proposes, in accordance with pertinent rules, that these remaining 4.3
acres will not be subject to the ten-year liability periods, or to the revegetation criteria, associated
with phased bond releases. Although no impacts from subsidence are known to exist, and no
reclamation task has been identified with retention of associated bond liability, the Division
proposes to also retain jurisdiction over areas of underground mine workings associated with the
Permit.
Acronyms and Abbreviations
Act Colorado Surface Coal Mining Reclamation Act (Title 34, Article 33,
Colorado Revised Statutes of 1973)
Applicant Minrec, Inc.
Application J: E. Stover & Associates letter of October 29, 2002,
same subject. The initial application identified the phase of the bond
release requested as Final. However, fmal accomplishment of certain
additional reclamation tasks has yet to be met, and the application was
amended. During processing of the Application, Phase I and Phase II bond
release was incorporated into the Application for some small elements of
reclamation work. The application is considered as a Partial Phase I,
Partial Phase II, and Partial Phase III bond release request.
CDMR Colorado Dischazge Monitoring Report
CDPHE Colorado Department of Health and Environment
Division Colorado Division of Minerals and Geology
OSM U.S. Department of the Interior, Office of Surface Mining Reclamation
and Enforcement
SL-O5, C-81-025, Mazch 24, 2003
Page 6 of 26 Pages
