<br />-2- <br />PROPOSED DECISION <br />CF&I STEEL CORPORATION <br />MAXWELL MINE <br /> <br />The Colorado Mined Land Reclamation Division proposes to approve, in part, <br />with stipulations, an application for a permit to conduct coal mining <br />operations submitted by CF&I Steel Corporation for the Maxwell Mine. <br />The Division is proposing to approve, with stipulations, surface activities <br />and development mining operations only. Prior to approval of secondary or <br />retreat mining, the permittee will have to resolve informational deficiencies <br />and secure Division approval through the revision process. <br />The approval decision is based on a finding that the proposed operations to be <br />approved will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seq. and the <br />regulations promulgated pursuant to the Act. <br />The permit application and the stipulations will become a binding part of the <br />permit upon approval. The stipulations for the Maxwell Mine are as follows: <br />Stipulation No. 1 <br />THE PERMITTEE MUST RECLAIM THE AREAS OF SEDIMENT POND #3, THE WATER <br />INTAKE POND, AND THE PUMP STATION TO CROPLAND CONSISTENT WITH THE <br />IMMEDIATELY SURROUNDING AREA, EXCLUDING THE ACTIVE STREAM CHANNEL. A <br />SEED MIX REFLECTING SPECIES CURRENTLY IN USE IN THE IRRIGATED HAYLANO <br />MUST•BE SUBMITTED FOR DIVISION APPROVAL WITHIN 60 DAYS OF PERMIT <br />ISSUANCE. THE INFORMATION IS TO BE SUBMITTED AS A REVISION TO THE <br />PERMIT. <br />IN ADDITION, PRODUCTIVITY FIGURES IN POUNDS PER ACRE FROM THE <br />IMMEDIATELY ADJACENT IRRIGATED HAYLAND AREA MUST BE SUBMITTED TO THE <br />DIVISION EVERY YEAR FOR THE FIVE YEARS OF THE PERMIT TERM. THIS FIVE <br />YEAR PRODUCTIVITY DATA BASE WILL BE USED IN SETTING REVEGETATION COALS <br />FOR CROPLAND. THE FIRST DATA IS DUE DECEMBER 31, 1984. SUBSEQUENT DATA <br />WILL BE DUE AT THE END OF EACH CALENDAR YEAR. <br />Stipulation No. 2 <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT A STATEMENT <br />CERTIFIED BY A REGISTERED PROFESSIONAL ENGINEER ATTESTING THAT THE 1W0 <br />SEDIMENT PO NOS HAVE BEEN CONSTRUCTED AS DESIGNED. <br />
