<br /> <br />To Whom it may concern: <br />This is to be an affidavit document concerning the past and <br />use of this road in question: <br />present <br />The road passing through what has always been known as C S Rail- <br />road land leading to a parcel which is described as the SE 1/4 of the W 1/4 <br />of section 35, twp 6, range 70 west of the 6th P.M. <br />This parcel of land has had only one access up a natural gulch <br />ing through the southern portion of the Railroad land. The access w. <br />established by Jarvis Wild about 1900; and in use since 1900 by all <br />consequential owners of the described parcel of land. <br />[n about 1955 through 1988, Mr. and Mrs. N. E. Kitchen wet leasors <br />and then owners. The access was traveled, as before, to reach the pr petty <br />and ended along the east boundary toward the far south. <br />The Kitchens tamed over the property in 1988 to Clyde and <br />Harmon with clear understanding that the access was a permanent <br />by the prescription provision. <br />~ - -~ <br />
