Introduction <br />This document is the approval package proposed by the Colorado Mined Land <br />Reclamation Division (the Division) for Permit Renewal No. 1 for the Peabody <br />Coal Company's (Peabody) Nucla Mine, located in Montrose, County (Figure 1). <br />The original proposed decision and findings of compliance were completed by <br />the Division on April 14, 1983 for purposes of bringing the Nucla Mine into <br />compliance with Colorado Permanent Regulatory Program. Permit C-81-008 was <br />issued on May 26, 1983 for a five-year term. <br />Peabody submitted Permit Revision No. 1 application on November 25, 1986 <br />modifying extensively the approved permit and incorporating an additional 6.6 <br />acres into the permit bringing the total permitted acreage to 426.6 acres. <br />This 10-volume application replaced in total the existing 4 - volume permit <br />document. Based upon the extent of this 10-volume application, the Division <br />issued a new findings of compliance and approval document on April 2, 1987 <br />which replaced in entirety the April 14, 1983 document. <br />On November 27, 1987, Peabody submitted Permit Renewal No. 1 application for a <br />second five-year permit term upon the expiration of the current permit on May <br />26, 1988. During the review process and public comment period, only minimal <br />concerns were addressed and two letters were received, respectively. Based <br />upon the minor changes required to the existing permit, the Division is <br />proposing to only update the existing April 2, 1987 findings of compliance <br />document to reflect the Permit Renewal No. 1 application. A11 pages of this <br />May 6, 1988 proposed decision and findings of compliance document are intended <br />as replacement pages to the April 2, 1987 document. Replacement pages are <br />noted by a May 6, 1988 date in the lower right-hand corner. <br />This document contains the proposed decision to approve Permit Renewal No. 1; <br />an updated summary describing the review process, a description of the <br />environment, and an updated summary of the operation and reclamation plan; and <br />the written findings of compliance that the Division is required to make <br />pursuant to the Colorado Surface Coal Mining Reclamation Act of 1979 (CRS <br />34-33-101 et seq). Detailed information about the proposed mining and <br />reclamation operations can be found in the ten-volume permit application <br />document which is on file in the public record maintained by the Division at <br />its offices and at the Montrose County Courthouse Annex in Nucla, Colorado. <br />-1- May 6, 1988 <br />
