C2) OSMRE, in conjunction with U.S. Fish and Wildlife Service, <br />determined that the proposed surface disturbances would have an <br />affect on critical deer winter range and raptor habitat, and <br />that the applicant had not provided adequate information on the <br />Unita Basin hookless cactus to assess the potential impacts. <br />The Colorado MLRD has added a stipulation to the permit which <br />requires that, within 60 days of permit issuance, the applicant <br />must submit a plan for the enhancement and manipulation of mule <br />deer critical winter range habitat to be affected by surface <br />operations which is developed in consultation with Colorado <br />Division of Wildlife and MI.RD. The original permit stipulated <br />that the applicant conduct raptor surveys during the summers of <br />i983 and 1984. Following the completion of the first survey, <br />the U.S. Fish and Wildlife Service (FWS) determined that the <br />information was adequate to assess future conflicts with <br />nesting raptors. The FWS also provided recommendations on the <br />establislvoent of buffer zones to protect nest sites of high <br />federal interest raptor species. The proposed central <br />facilities area permit revision involves substantial changes to <br />the original mine plan and significant increases in the area of <br />disturbance. Therefore, Colorado MLRD added a stipulation to <br />the permit requiring the applicant to maintain raptor buffer <br />zones established for the Munger Canyon mine in 1983. <br />The applicant was required to conduct a Unita Basin hookless <br />cactus study which showed that the proposed operation would not <br />impact any of these plants. <br />
