C2) OSMRE, in conjunction with U.S. Fish and Wildlife Service,
determined that the proposed surface disturbances would have an
affect on critical deer winter range and raptor habitat, and
that the applicant had not provided adequate information on the
Unita Basin hookless cactus to assess the potential impacts.
The Colorado MLRD has added a stipulation to the permit which
requires that, within 60 days of permit issuance, the applicant
must submit a plan for the enhancement and manipulation of mule
deer critical winter range habitat to be affected by surface
operations which is developed in consultation with Colorado
Division of Wildlife and MI.RD. The original permit stipulated
that the applicant conduct raptor surveys during the summers of
i983 and 1984. Following the completion of the first survey,
the U.S. Fish and Wildlife Service (FWS) determined that the
information was adequate to assess future conflicts with
nesting raptors. The FWS also provided recommendations on the
establislvoent of buffer zones to protect nest sites of high
federal interest raptor species. The proposed central
facilities area permit revision involves substantial changes to
the original mine plan and significant increases in the area of
disturbance. Therefore, Colorado MLRD added a stipulation to
the permit requiring the applicant to maintain raptor buffer
zones established for the Munger Canyon mine in 1983.
The applicant was required to conduct a Unita Basin hookless
cactus study which showed that the proposed operation would not
impact any of these plants.
