BAILEY: For the record, we
4 have previously raised with you the methane issue
5 and whether a driller might encounter methane. I
6 don't want Mr. Thompson's response to your question
7 to be construed as some suggestion that we are
8 disclaiming that. I mean, it's possible that
9 methane would still be encountered as part of that
10 process, drilling process, and the fact that his
11 response didn't mention that doesn't mean that
12 that's not a possibility still.
13 Q. So, to clarify that, the fact that this
14 shaft is now full of water wouldn't negate the
15 possibility that you would encounter methane going
16 down there?
17 A. No. They could be conceivably from the
18 mine or from other strata and if the driller is
19 aware of that possibility he can take precautions.
20 Q. Now, I want you to assume with me, if
21 you will, that heretofore we had been advised that
22 the underground works towards my house there had
23 never gotten closer than about seven hundred lineal
24 feet from the house, but that contention and
25 position has since been revised and now we are
7,
EARL E.
