BOx t82t <br />COLORADO SPRINGS COLORADO 60901 <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver CO 80203 <br />Deaz Mr. Long: <br />'~~'CElv~r <br />APR 2 ~7 ?000 <br />Civ~sran ofMin@rdfs d L,.;:.~cG~ <br />`~ r~c~~~ <br />We received David Berry's Apr. 20th letter which indicated that you had been sent a copy. <br />We would like to clarify a few of the points concerning the recent proposed project for the <br />GEC site. <br />Mr. Berry called Anne Corley Maz. 29th asking for permission for access to the GEC site. <br />She suggested that he arrange access with Energy Fuels. After the pre-bid meeting Mr. <br />Berry called Anne again and said that he had some concerns. He told Anne that John <br />Nelson was to be the supervisor and that he knew that might be a problem.. He also asked <br />for permission to remove a certain knob of undisturbed area for fill material .Finally, he <br />said that he hoped that Phil Kessler would be the successfiil bidder and that~about eight <br />other contractors had not gone to the right location for the meeting. He said that he <br />hoped that "natural selection would weed them out". We informed him that we did not <br />know what the plan was, and Mr. Berry sent us a packet of information on Apr. 11th <br />including a picture of the knob. We told Mr. Beny that John Nelson was an objection, <br />and he replied that John did not have to be included. <br />Upon receipt of the plan, we visited the azea and talked with Energy Fuels and Phil <br />Kessler. It was very obvious that an excessive amount of work was planned. I contacted <br />Mr. Beny prior to Apr. 18th and told him that Mr. Kessler said that another alignment <br />would save a quarter to a third of the cost. I told him that if Mr. Kessler was the <br />contractor I would allow John Nelson to be the supervisor. Mr. Berry said that he hoped <br />that Mr. Kessler was the low bidder and that if be wasn't Mr. Berry said that he would <br />"get creative". <br />Mr. Beny notified Anne on about Apr. 17th that Tezak was the successfiil bidder. It <br />should be noted that Mr. Tezak was one of the contractors that did not go to the right site <br />for the bidders' meeting, and that he did not attend the entire meeting. The Special <br />Conditions specify that "Failure to sign in or to attend the entire meeting will be cause for <br />rejection of a bid". On Apr. 19 Anne visited Mr. Berry in Denver and told him that John <br />Nelson would not be agreeable to us and that the knob was definitely not to be used. Mr. <br />Berry told Anne that John would have a minor role and that Mr. McArdle and Mr. Berry <br />
