As previously stated, this request summarizes <br />your telephone conversation of October 29, 2001, with Joby Adams (C.G.R.S.), <br />regarding permit requirements far the Varra Coal Ash Project. <br />- There is a Memorandum of Understanding (MOU) between Division of Minerals <br />and Geology (DMG) and Colorado Department of Public Health and <br />Environment (CDPHB~E) which address the issues of imported waste (inert) at <br />mine sites, including fly ash. However, it is your understanding that DMG does <br />not recognize the MOU fir a variety of reasons, including the state's current <br />ability to bond various projects. <br />- Varra Companies wishes to extract the pilot project study area from its DMG <br />permit area in order to satisfy requirements of the Use by Special Review <br />permit. <br />- The extracted area will consist of the area occupied by the coal ash trench and <br />monitoring well network. This area is estimated to cover approximately 1.43 <br />acres. The attached figure depicts the study area. Only the Pilot Project study <br />area will be extracted. <br />identified in the field with a metal pipe or other durable marker. <br />- As requested in your subsequent correspondence of 14 November 2001, a 50 <br />foot buffer from each feature will circumscribe the extraction areas from the <br />surrounding DMG permitted lands.
