• • <br />The Applicant filed an application with the Division on June 3, 2003. The <br />original decision date of September 2, 2003 was postponed to October 1, <br />2003 pursuant to an extension request filed by the Applicant on July 21, <br />2003. <br />4. Numerous parties filed timely objections to the application. <br />The Board has jurisdiction over the parties and the subject matter of this <br />proceeding pursuantto C.R.S. Section 34-32.5-114. <br />6. The Board appointed a prehearing conference officer who conducted a <br />prehearing conference on August 19, 2003 in Montrose, Colorado. The <br />prehearing conference officer prepared a proposed prehearing order. <br />Parties who appeared at the prehearing conference included the Applicant, <br />Objectors Dave and Kathy Casias, Mike and Myrna Shirey, Theron and <br />Vera Carlson, J. Merch Ward, Thomas Waird, Gerald and Suellen <br />Hubbard, Duane and June Reneker, Emily Schneider, Kay Wiesner, <br />Delmar Wiesner, Susan Pritchett and Friends of Spring Creek, represented <br />by Susan McIntosh. All other objectors failed to appear, and thereby lost <br />their party status pursuant to Construction Materials Rule 2.7.3(4). <br />The Board approved the proposed prehearing order with one modification. <br />At the request of the Applicant and with the consent of the Objectors, the <br />Board considered and unanimously approved a motion to strike the issue <br />concerning the placement of an earthen dam on the property, identified in <br />the prehearing order as issue #3. <br />
