<br />We recently received a February 20, 1994 letter from you which <br />indicates you, "did not say that we did not want to proceed with <br />the revised West Pit plans". As a result of your conflicting <br />statements, the Division does not know what your position is in <br />regard to the proposed West Pit work. <br />Lacking a signed modification to the previous agreement, the <br />Division is obligated to proceed with the original drainage plans <br />for the West Pit, within the financial constraints of the available <br />funds. If we receive a signed copy of the proposed modified <br />agreement by March 4, 1994, we will have Kessler Reclamation Co. <br />proceed with the second plan. A copy of the proposed agreement <br />(originally forwarded to you on December 29, 1993) is enclosed with <br />this letter.
