Box 1821 <br />Colorado Springs, CO 80901 <br />RE: GEC West Pit Reclamation <br />Dear Dr. Corley: <br />Since I have not been able to reach you by phone this week, I <br />wanted to notify you of the Division's plans for completion of the <br />GEC West Pit drainage improvements. The Division will be meeting <br />with Phil Kessler on the site during the second week of March to <br />discuss which of the two proposed drainage plans to implement and, <br />any necessary modifications to the first plan, should that plan be <br />selected. <br />As you know, the first plan follows concepts which you proposed to <br />the Division in 1993. The second plan was developed after <br />construction bids for the first plan were higher than anticipated. <br />In an August 26, 1993 letter to the Division, you indicated that <br />you thought an alternative to the first plan should be developed. <br />The Division forwarded those alternate plans and draft language for <br />modifying an earlier agreement between the Corley Company and the <br />Division regarding the first plan on October 26, 1993. Since that <br />time, the Division has solicited your comments or acknowledgement <br />of the revised agreement in writing on six separate occasions. <br />other than the comments in your October 29, 1993 letter (to which <br />the Division responded on November 8, 1993), we received no <br />acknowledgement of the proposed agreement until receipt of your <br />January 25, 1994 letter. <br />Your letter of January 25, 1994 stated, "We no longer wish to go <br />ahead with our suggested compromise". The "compromise" apparently <br />referred to the arrangements made in our December 21, 1993 meeting <br />in regard to the proposed revised agreement. Consequently, the <br />Division notified you that we would have Kessler Reclamation Co. <br />proceed with the original plan, as previously indicated in an <br />October 15, 1993 letter from the Division Director to the Corley <br />Company. <br />
