<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />WRITTEN TESTIMONY OF RICHARD BABNICK, RATON-WEST BALDWIN LTD. <br />DEVELOPMENT <br />IN RE: CONSIDERATION OF TECHNICAL REVISION 28 REQUESTED BY BASIN <br />RESOURCES, INC., FOR THE GOLDEN EAGLE MINE IN LAS ANIMAS COUNTY <br />This testimony has been prepared by Mr. Richard Babnick. Mr. <br />Babnick is the Projects Manager for the Baldwin Company at Trinidad <br />Colorado. <br />TR-28. We had hoped to have resolved issues as to exploration <br />holes prior to this Hearing. I went to each hole location with Mr. <br />Qw 7a~wvs~ <br />Ra~gh-3~egea of Basin about two weeks ago and we reached tentative <br />concurrence on most hole locations and access. Please be aware <br />that Raton West does not own the land where most holes will be <br />located, but is concerned with the effect on Rancho Escondido and <br />on the value of its remaining lots. Our attorney made a written <br />proposal to Basin but as of early this morning we had no response <br />from Basin. This conduct is not reasonable. Even though it is not <br />our obligation, we have a proposal as to provisions that the Board <br />may place in an approval of TR-28 (Exhibit 48). ~ However, we <br />believe that it is Basin's obligation to show the necessity of each <br />hole, particularly holes that it insists on placing some distance <br />from the established Rancho Escondido road network. <br />I incorporate into my testimony by reference Raton West's <br />Exhibits 36, 37, 38, 46 and 48. <br />EXHIBIT <br />Raton West <br />sz <br />--- E <br />
