FURTHER PROVISIONS CONCERNING TR-28 <br />(PROPOSED BY RATON WEST FOR INCLUSION IN GOLDEN EAGLE MINE <br />PERMIT. Please be advised that Raton West does not own the land <br />upon which many of the intended exploration holes will be drilled, <br />and does not have any authority, as to lands owned by others, <br />either to grant permission to Basin to conduct such drilling or to <br />determine the conditions under which such drilling may be done. <br />Raton West's role as to holes not located on its own land is simply <br />as a concerned member of the public.) <br />As a provision applicable to all holes, equipment will only be <br />moved when the ground is hard and dry in order to avoid rutting and <br />other damage. <br />All holes shall be drilled pursuant to monitoring well permits <br />from the State Engineer's office so that they can later be <br />converted to water wells if the landowner so desires. These wells <br />shall be left open to aquifers encountered in the drilling process. <br />Access routes to all holes shall be fully reclaimed back to <br />travelled Rancho Escondido roads, and access to such access routes <br />closed off at the roads. <br />The following additional provisions are made: <br />NM-21 The location immediately west of the road, in Lot <br />14 or Lot 15, depending on final site selection, is <br />reasonable. <br />NM-25 Since this hole is east of the Rancho Escondido <br />boundary, beyond the end of the road, Basin is <br />required to get permission from Raton West to use <br />Rancho Escondido roads to access this location, and <br />must obtain permission from any individual <br />landowners whose land is proposed to be crossed. <br />NM-27 The location immediately east of the road, in lot <br />C11, is reasonable. <br />NM-28 The location immediately west of the road, in lot <br />C2, is reasonable. <br />\tr28prop.per <br />EXHIBIT <br />Raton West <br />~,/ 8 <br />
