Stipulation No.21 continued.
EFCI's response was to validate the 26-29 degree measured for
the angle of draw. Revised permit pages, revised leasing
boundaries and maps accounting for the new angle of draw are
to be submitted as part of the permit renewal process this
year. EFCI's response was received by the Division on January
17, 1994 after receiving an approval for extension from the
Division on December 29, 1993.
The Division concurs with this response and hereby notifies
that Stipulation No.21 is complied with and terminated with
the revised angle of draw to be 26-29 degrees. Details will
be worked out through the permit renewal adequacy process.
3. Stipulation No.22
EFCI was to submit revised pond as-builts for the two loadout
ponds and pond No.5 at the mine site. Date of requested
submittal: January 31, 1994.
EFCI's response was faxed on January 31, 1994 with certified
maps received February 4, 1994.
The Division hereby notifies that Stipulation No.22 has been
satisfied, complied with and is terminated.
4. Stipulation No.23
This stipulation is for bond re-assessment and remains in
effect from the 1993 Mid-term review. This stipulation will
be addressed in the permit renewal process this year as is
indicated in the stipulation wording.
This concludes the Division's review of the Stipulations outlined
as Mid-term issues that were to be addressed and completed by the
end of January 1994. The Division appreciates EFCI's prompt
response and timeliness to address these stipulations.
Thank you for your conscientiousness. Should you have any
questions regarding these matters, please feel free to contact my
office for further discussion.
Since ely,
~~CLu~/ y~'L
n E.
