Stipulation No.20 <br />This stipulation requested submittal of a permit application <br />to the State Engineer's Office to renew the application for <br />the north dewatering well by January 31, 1994. <br />EFCI's response, dated February 8, 1994 stated that the file <br />was reopened with Mr. Al Eckermann of the State Engineer's <br />Office contacted to address the two outstanding items which <br />are: waiver from the landowners of three adjacent wells and <br />an augmentation plan to be submitted for waters in transit. <br />EFCI's response included copies of the waiver letters sent to <br />Dr. Corley and Mr. Thompson; owners of the three wells. The <br />consultant firm of Bishop-Brogden Associates, Inc. is <br />currently developing an augmentation program for the mine. <br />The Division is satisfied with this response and hereby <br />notifies EFCI that Stipulation No. 20 is complied with and <br />terminated with the final permitting of the north dewatering <br />well to be addressed in the permit renewal process this year. <br />2. Stipulation No.21 <br />This stipulation requested information to support EFCI's <br />contention that the angle of draw in the subsidence reports as <br />26-29 degrees was an anomaly and did not reflect the <br />conditions of subsidence effects at the mine.
