Oepl of Natural Resources <br />Re: The Rockcastl'e Company <br />Grassy Gap Coal Mine <br />Responses to Proposed <br />Stipulation <br />Following are Rockcastle Company's responses to proposed stipulations <br />8, 10, 11, 12, and 13 on the Proposed Decision for Grassy Gap Mine. This <br />is to be combined with Tommy Raye's responses dated November 26, 1984 on <br />the remaining stipulation. As I indicated, we have not yet received <br />confirmation of Wagner's equipment rates, but, at your suggestion, will <br />forward them under separate cover to you when they arrive. <br />Stipulation No. 8: <br />Attached is a copy of plans and cross-sections for the reclaiming <br />of sediment ponds at Pits 2 and 3. These were submitted originally <br />at our meeting in Denver on November 2, 1984. Pit 4 sediment pond <br />will be reclaimed in accordance with our application. <br />The plans and cross-sections are designed to demonstrate compliance <br />with Rule 4.14.1(2)(a) which specifies that spoil be "graded to <br />eliminate all highwalls, spoil piles and depressions". <br />Stipulation No. 10: <br />Within 30 days of the publication of the CMLRD Board's decision, <br />the application text will be updated to reflect actual conditions <br />at the mine, as depicted on the mining plan map submitted May 4, 1984. <br />Stipulation No. 11: <br />A. The remainder of the main haul/access road not shown on the <br />permit map was submitted on November 27, 1984, and a copy is <br />attached. All embanl®ent slope grade restrictions are in accord- <br />ance with the regulations. Portions of the roadway exceeding cut <br />slope grade restrictions in the regulations are shown on the <br />P. 0. BOX 1038. JANESVILLE. WISCONSIN 53545 <br />
