<br /> <br />Grantors also grant to Grantee a right to cross property owned by Grantors, <br />their successors or assigns, to access the above described easement for purposes <br />of inspection, repair and maintenance of the facilities of Grantee along South <br />Platte River." <br />The easement line was staked and pinned in the field and should be easily <br />identifiable in the field, at least before the unauthorized fill was placed. If the survey <br />pins were destroyed in the interim they will also need to be replaced at your expense. <br />We also insist that you abide by the terms of the Easement Deed which includes <br />removing the unauthorized fill material within ninety days and restoring any disturbed <br />areas to pre-violation conditions, including revegetation of the disturbed areas to <br />District's satisfaction. <br />In addition to the easement issue described above, it appeazs that Adams County <br />Floodplain Use and/or Colorado Mined Land Reclamation Board regulations may have <br />also been violated by the fill in the floodway and by the proximity of the mining <br />operations to the river's channel. Please call me at 455-6277 to discuss this issue and <br />how to best resolve it. We have along-standing tradition of working well with the <br />property owners along the Platte River and would like to maintain a working relationship <br />with you that works best for both of our interests. However, we cannot allow a total <br />disregazd of our easement interest to continue.
