Box 2110 <br />Silverthorne, Colorado 80498 <br />Re: Urban Drainage and Flood Control District Easement encroachment along <br />South Platte River north of Creekside Nursery <br />Dear Mr. Hammer: <br />On May 25, 1995 we conducted a field inspection of the South Platte River adjacent <br />to your mining activities just north of the Creekside Nursery property in Adams County. <br />We believe that unauthorized fill, construction and stockpiling of material has occurred <br />inside the Urban Drainage & Flood Control's easement limits on the west bank. None <br />of this has been approved by the District and violates the restriction and conditions of the <br />easement. As a result, this needs to be addressed immediately. <br />I am sending you copies of the easement agreements executed between the Urban <br />Drainage and Flood Control District and the Carlson family. Since you were not <br />involved in the original easement grant process but now own this property, we duect <br />your attention to the following excerpt contained in both Easement Deeds: <br />"In further consideration hereof, Grantors for themselves and their <br />successors and assigns covenant and agree that no building, structure, fill of <br />soils or other materials, or other above or below ground obstruction that will <br />interfere with the purposes aforesaid, will be placed, erected, i~rstalled or <br />permitted upon the above-described premises without written authorization of <br />the Grantee; and further covenant and agree that in the event the terms of this <br />paragraph are violated by Grantors, their successors or assigns, or any person or <br />organization working directly or indirectly for the Grantors, or one or more of <br />Grantors, their successors or assigns, such violation will be corrected and <br />eliminated within ninety (90) calendar days after the receipt of notice from <br />Grantee. If such corrections are not made by the Grantors, their successors and <br />assigns or whoever is the current owner of the fee title to real property <br />described in Exhibits, if different from Grantors, within said ninety day period, <br />the Grantee shall have the right to correct and eliminate such violation, and the <br />Grantors, their successors and assigns or whoever is the current owner of the <br />fee title to the real property described in Exhibits, if different from Grantors <br />shall promptly pay the actual costs thereof. <br />
