During the mining operation, the Colorado Cooperative Ditch Company irrigation ditch had to be <br />Temporarily relocated. The ditch was temporarily relocated to an above ground pipeline using the corridor <br />shown on Figure 1. Following muting in the azea, the ditch was moved to it's pem~anent location and <br />buried in an underground pipeline. The focus of this bond release is only for the minimal grading activities <br />that occurred in the temporary pipeline comdor. <br />WFC has aself--bond in place for the reclamation of the New Horizon Mine in the amount of <br />$4,000,000.00. This application pertains to a reduction in the bond liability only and no release of <br />any money is proposed. The specific area that the bond release applies is in the Mine 2 area and <br />encompasses not more than 5.0 acres. The reclaimed location of the temporary pipe line is near the <br />intersection of 2700 Road and BB Road with its point of beginning at the West Lateral Canal <br />northeast of the intersection and the terminus at 2700 Road south of BB Road. The reclaimed azea is <br />25 feet in width with 12.5 feet on each side of the temporary 26 inch irrigation pipe line and the total <br />length of the temporary pipe line corridor within the permit boundary was estimated to be 4,270 feet. <br />An application for bond release was received by the Division on May 17, 2007. The application was <br />deemed complete on June 13, 2007, after the Division received proof of publication of the applicant's <br />public notice. WFC published notice of the bond release application in San Miguel Basin Forum once <br />weekly for four consecutive weeks, beginning May 24, 2007. WFC also notified land owners within <br />and adjacent to the mine permit area, and other interested parties of the application for bond release, as <br />required by Rule 3.03.2(1). <br />No comments, written objections, or requests for an informal conference regarding the bond release <br />application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on July 11, 2007. The site inspection <br />was conducted in accordance with Rule 3.03.2(2). Mr. Mike Boulay of the Division and Mr. Ross <br />Gubka, Chief Engineer for WFC attended the inspection. Mr. Zene Weimer, President and Mr. Dean <br />Naslund, Superintendent of Colorado Cooperative Ditch Company accompanied the Division and <br />WFC during the entire inspection. None of the other land owners of record attended the inspection; <br />however, all land owners were notified of the inspection via certified mail. <br />No signifcant adequacy questions or concerns were raised by the Division during the inspection and <br />there were no separate adequacy correspondence letters sent to WFC. <br />4 <br />
