I. PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />WFC applied for a Phase I bond release under the Colorado Surface Coal Mining and Reclamation Act. <br />The mine is located in Montrose County, Colorado, on lands included within: <br />Mine 1: <br />SW'/a, Section 25, T47N, R16W containing 98.62 acres MOL shown on the USGS 7.5 minute <br />Nucla Quadrangle map. <br />Mine 2: <br />NW'/o, Section 6, T46N, R15W <br />E%z, Section 6, T46N, R15W <br />E''/zW%z, Section 6, T46N, R15W <br />N%, Section 1, T46N, R16W <br />SW'/e, Section 31, T47N, R15W <br />SW'/<NW'/4, Section 31, T47N,R15W <br />NW'/<SW'/o, Section 31, T47N, RISW <br />S%z, Section 36, T47N, R16W <br />N''/z Section 36, T47N, R16W <br />SW%< Section25, T47N, R16W <br />The above mentioned tracts of land containing approximately 823.56 acres are shown on the <br />USGS 7.5 minute Nucla Quadrangle map. The total permit acreage for both mine azeas is 922.16 <br />acres. The bond release request covers the reclamation work for the temporary pipe line corridor <br />and was limited to removing the pipe line from the temporary location and relocating it by <br />burying in the approximate original ditch location. A map prepared by WFC for this bond <br />release request showing the temporary and permanent location of the pipe line is attached as <br />Figure I. <br />WFC purchased the Nucla and Nucla East Mines from Peabody Coal Company and renamed them the <br />New Horizon Mine 1 and 2 respectively. The transfer of ownership and succession of operator was <br />completed on May 15, 1992. At this time, the New Horizon Mine 1 permit azea encompasses <br />approximately 98.6 acres. The Mine 1 area has been revegetated for longer than 10 yeazs. The New <br />Horizon Mine 2 azea encompasses approximately 823.56 acres. Approximately 653.5 acres will be <br />disturbed from mining or related activities at Mine 2. Surface mining operations are presently active <br />at the Mine 2 area. <br />The mines aze located in the Nucla-Naturita coal field. The New Horizon Mine 2 primazily produces <br />coal from the Lower Dakota coal seam and utilizes the Upper Dakota coal seam when the seam is <br />thick enough and of sufficient quality. The lower Dakota coal seam at New Horizon Mine 2 ranges in <br />thickness from 4.2 feet to 6.9 feet and is 99 feet above the top of the Burro Canyon Formation. The <br />coal dips 4.5° S W along a strike of N 45° W. <br />3 <br />
