Only in this way are lower <br />seams protected from the fracturing and in the ensuing sterilization <br />caused by the subsidence from mining in the upper seams. Thus, while <br />continuing to exhaust the remaining "F" seam reserves in adjacent or <br />nearby leases, Empire is presently developing what will be known as our <br />No. 6 Mine in the "E" seam. Pursuant to our mine permit revision <br />C-81-044 received by Empire in June, this development will lead to the <br />resumption of mining on D-056298 by 1990. <br />Because lease D-056298 is an integral part of our operation in the <br />transportation of coal and for the extraction of the remaining "F" seam <br />reserves, we ask that this application be considered concurrently with the <br />attached Right-of-Way application. Empire acknowledges that the <br />right-of-way will not permit or authorize further production of coal from <br />the lease during the period of suspension. <br />Empire Energy believes that this request for a suspension of operations <br />and production is made in compliance and accordance with Section 39 of the <br />Mineral Leasing Act (30 U.S.C. 209) and further states that the lease <br />rental and royalty account is in good standing with the Minerals <br />Management Service. <br />Please let us know if you require further information and thank you for <br />your attention. <br />Sincerely, <br />~ w;~~. <br />V.
