Based on cost <br />estimate review performed by the Division during the mid-term review, the reclamation liability increased from <br />$1,803,487.00 to $2,049,361.00. A bond rider increasing the surety held by the Division to $2,049,361.00 was <br />submitted in association with TR-46. <br />TR-47 proposed approval decision was issued November 29, 2005. The revision allowed for modification of <br />Sediment Pond 11 (emergency spillway elimination). Note that an earlier version of TR-47 Pond 11 design <br />modification had been submitted on October 17, 2005, but was retracted by letter dated October 25, 2005. <br />TR-48 proposed approval decision was issued Janurary 5, 2006. The revision allowed for use ofthe unit train <br />loadout by a trucking company to receive freight by rail, and allowed for installation of a new rail switch, and <br />limited site grading to accommodate the use. Cargo including bulk sand, cement and bentonite would be <br />offloaded directly from rail cars to trucks. Additional cargo (bagged bentonite and pipe) would be temporarily <br />stored in designated locations within the sediment controlled area of the loadout. <br />TR-49 was formally withdrawn by the operator by letter dated February 15, 2006. <br />TR-50 proposed approval decision was issued July 25, 2006. The revision allowed the operator to discontinue <br />monitoring of four springs and seeps within the permit area. <br />TR-51 proposed approval decision was issued September 20, 2006. The revision allowed for extension ofthe <br />reclamation schedule by one year, to allow for Division review ofa postmining land use change permit revision <br />application applicable to the South Portals area. <br />Minor Revisions <br />MR-70 approval decision was issued October 3, 2005. The revision amended the reclamation plan to address <br />control of cheatgrass at the North Decline Area, and to allow interseeding and remedial seeding in certain <br />locations, with specified seed mixtures. <br />MR-71 approval decision was issued November 18, 2005. The revision replaced Map Exhibit 1 1 B with an <br />updated digital format version of the exhibit. <br />MR-72 approval decision was issued October 4, 2006. The revision modified the seeding rate for North <br />Decline interseeding conducted in November 2006. <br />Permit Revision No. 3 Review Process <br />Snowcap Coal Company, Inc. (SCC) submitted an application for Permit Revision No. 3 (PR-3) to Permit C- <br />81-041, on August 4, 2006. The submittal included a revision application form, proposed public notice, cover <br />letter, and various amended map exhibits, narative pages, tables, figures, and exhibits. As explained in the <br />initial submittal package, the purpose of the revision application is to change the postmining land use of <br />portions of the South Portal facilities area to an altemative, Commercial postmining land use. Under the <br />proposed plan, the site would be used by a commercial fruit growing company (Providence Place, [nc), which <br />has entered into alease/purchase agreement with SCC. The fruit operation at the site would make use of <br />existing facilities for a retail sales office, produce storage, equipment and supply storage, and parking.
