Following the review process for the initial permanent program permit application, the Division issued a permit <br />with stipulations on January 3, 1983. <br />On November 9, 1984, Powderhorn Coal Company submitted plans for a perrnil revision to construct two new <br />coal processing waste embankments to be located north (CRDA-2) and west (CRDA-3) of the existing Cameo <br />Refuse Disposal Area (CRDA-I ). This revision was approved on March 1 l,, 11985. <br />I'' <br />In October 1986, Powderhotn Coal Company notified the Division oftemporagccessation ofoperations at the <br />Roadside and Cameo Mines. In eazly 1987, Peabody Holding Company (Peabody) purchased the inactive <br />Roadside and Cameo Mines. Peabody retained the Powderhorn Coal Company name for the company. On <br />April 20, 1989, Powderhgtn Coal Company (PCC) notified the Division of its ineent to emerge from temporary <br />cessation status on May I, 1989. The mine was active from that date, until December, 1999, producing up to <br />70,000 tons of clean coal per month. Up until November 1994, production was limited to the Roadside South <br />Portal, but at that time the North Portal was reactivated, and coal was produce from both portals until early <br />1997, when all coal production was shifted to the North Portal. Due primarily toicoal quality problems, mining <br />ceased on December 2, 1999. By letter of December 13, 1999, the operator notified the Division that cessation <br />ofoperations would extend beyond 30 days. A subsequent letter received by thi:' Division on March 14, 2000, <br />provided official notice that the cessation ofoperations was permanent, pursuant to Rule 4.30. Current (July <br />2007) official status of the operation is "Active", due to approved use of the unit train loadout for material <br />storage and loading, and due to periodically on-going reclamation activity. There are no plans for future coal <br />extraction at the operation. <br />The original permit has been granted renewal for successive five year permit terms three times, the most recent <br />renewal decision was finalized October l7, 2003, for a permit term extending tlirough January 3, 2008. One <br />stipulation (No. 22) was attached to the 2003 permit renewal (RN-04), and remains in effect. Several technical <br />revisions (TR's) and minor revisions (MR's), were submitted and processed since the most recent mid-term <br />permit review (August 2005). The stipulation and permitting actions are sumrriarized below. <br />Status of Previous Stioulations <br />One stipulation (Stipulation 22) was attached to the 2003 RN-04 renewal permit and proposed decision. <br />Stipulation No. 22 requires specific documentation to be provided prior to initiation of mining within the <br />subsidence angle of draw beneath the 345 KV Rifle-San Juan Powerline, within the South Portals mining area. <br />Mining operations have ceased, and the portals have been sealed. As such, it is likely that the concerns <br />addressed by the stipulation will not be realized. The stipulation is retained as a precautionary measure, in the <br />unlikely event that operations would re-initiate in the future. <br />Pennittin¢ Actions Processed Since August 2005 Mid-term Permit Review <br />Technical Revisions <br />TR-45 proposed approval decision was issued October 11, 2005. The revi~;ion allowed for reclamation <br />schedule extension to allow operator time to finalize a pending property sale, amJ prepare a postmine land use <br />change revision application. <br />TR-46 proposed approval decision was issued December 13, 2005. The revi~;ion provided permit updates <br />requested by the Division based on the mid-term permit review.
