Box 226 <br />Delta, Colorado 81416 <br />Re: Stipulation Response, File No. C-034-81 <br />Dear Mr. Reschke: <br />The Division has reviewed responses to Stipulations No. 1 and No. 3. The <br />Stipulation No. 2 response will be reviewed in the near future. <br />/The response to Stipulation No. 3 is satisfactory. The alternative sediment <br />cnrtt`rol measures proposed for the 4.8 acre area east of the railroad tracks at <br />the loadout are acceptable and, pursuant to Rule 4.05.2(3), the Division <br />hereby grants a small area exemption from the sediment pond requirement for <br />that area. <br />With respect to the Stipulation No. 1 response, we have the following comments: <br />1. The basis for allowing sufficient capacity for only 24 hours of <br />mine water storage should be provided. <br />2. The response states that mine water is primarily settled <br />underground. A description of how this is accomplished should be <br />provided, in light of the fact that, in the past, mine water pumped <br />into the pond has contained relatively high amounts of suspended clay <br />particles. <br />3. The Division generally requires that sufficient capacity be <br />provided to allow for 3 year's sediment storage. This is primarily due <br />to the fact that, during the period following reclamation equipment is <br />generally not readily available and the 3 year sediment storage reduces <br />the maintenance frequency. In this case, since the pond will be <br />replaced prior to final reclamation the 3 year requirement can be <br />waived. However, since frequent maintenance may be necessary, we will <br />require that Grand Mesa commit to sediment survey on a quarterly basis. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
