John A Eilts <br />Coal View Ghost Ranch <br />Mystic Trail 17880 US 40 <br />Steamboat Springs, Co.80487 <br />October 3, 1988 <br />To: Concerned Citizens <br />The Colorado Mined Land Reclamation Division (CMLRD) and the Federal Dffice <br />of Surface Mtning (OSM) are required by law to preserve, and closely restore, the <br />environment dealing with mining operations. Have these requirements been <br />accomplished? <br />The CMLRD and OSM are now contemplating releasing the bond of the "Hau} <br />Road" to this land owner. However, there are some questions that have to be <br />answered! <br />1. Why did the CMLRD insist in destroying a perfectly good road to <br />install 90 one (1) foot deep by 15 to 25 feet wide ditches across it? What use <br />van this mud hole road be put to? And was any consideration given to the future <br />repair of the road? Much less, grading the road or snow removal? Furthermore, <br />why was there no court action taken against Sun Coal for placing round rocks, and <br />filling in the ditches of the road? And the final part of this question, does <br />the CMLRD intend to pay for the damages caused by their own failure? <br />2. What action will be taken to correct the four slide areas caused by <br />Sun Coal on and next to the Haul Road? <br />3. Why are the berms and the steep slopes still present and without <br />vegetation? <br />4. Why is silt allowed to build up in our ponds, while it is removed <br />from theirs to bury cattle on other land, or to be piled up and not terraced? <br />5. How can the CMLRD allow grazing on our reclaimed unfenced land, while <br />there is no veggetation or trees on it? <br />6. Wfty has the CMLRD allowed and caused more erosion on our land due <br />to the haul road ditches? Why are the large rocks there, and are they going to <br />be removed? <br />7. Why has the CMLRD allowed our water to be diverted directly into the <br />Yampa River for at least 30 days each year? <br />8. How has Sun Coal managed to get around replacing the sod or making <br />our airfield useable? <br />9. Who is going to pay for restricted road use and damages so far? Are <br />any of,the ditches lack of road use or damages attributed to court order <br />violations? Note, in the court order "the road shall remain as is, except work <br />necessary to solve drainage problems' <br />The road must now be reconstructed to eliminate berms, steep slopes and <br />ditches(see court order). The drainage problems are now greater than ever <br />before, and have created other problems. We will, however, be willing to accept <br />the road, as it is now, if a satisfactory financial agreement can be reached <br />soon. <br />Thanks folks, work hard and smile! <br />w <br />hn A.
