Stipulation No. 32 <br />APPROVAL OF THE POST MINING ROAD RETENTION, DEPICTED ON EXHIBIT 12-9, IS CONDITIONED <br />ON THE DEMONSTRATION OF COMPLIANCE WITH THE REQUIREMENTS OF RULE 4.03.2 <br />MCLUDING: SUBMITTAL OF A DETAILED DESIGN AND CERTIFICATION OF THE DESIGN FOR THE <br />PERMANENT ROAD (S) AND A REQUEST FROM THE LANDOWNER IN WRITING THATTHE ROAD (S) <br />IS TO BE LEFT OPEN FOR FURTHER USE. <br />Origination: Permit Renewal No. 3 <br />Status: Ongoing <br />SECTION IV -MIDTERM ADEQUACY QUESTIONS <br />As a result of this midterm review the Division will require revision of the permit application <br />package and has the following midterm adequacy review questions. <br />1. The permanent roads depicted on Exhibits 12-9 and 13-2 were originally designed and <br />constructed as haul roads. The roads will be narrowed and retained as access roads. Approval of <br />the post mining road retention is contingent upon compliance with Stipulation No. 32. Please <br />provide a design and certification of the design for the permanent roads shown on Exhibit 12-9 <br />and 13-2, and provide a request from the landowner in writing that the road(s) aze to be left open <br />for further use. <br />2. As noted in several recent inspection reports (conducted May through July 2004) spring <br />runoff caused significant erosion and the formation of several gullies on the south-facing slope at <br />the lower end of the former East Wadge pit and final dozer pit locations. The gullies were <br />repaired and the eroded azeas were roughened and broadcast seeded prior to the May 26, 2004 <br />inspection. The uppermost azea of erosion above Post Mine Channel PM-8 receives a substantial <br />amount of runoff, and it appears that either armoring or additional drainage channel density will <br />be necessary at this location to protect the azea from future erosion and to adequately convey <br />runoff to PM-8. A significant gully has also formed at the head of PM-8, east of the elk fence. It <br />was also noted that one of the repaired gullies located above and to the west of PM-8 has been <br />graded into a v-shaped channel and seeded. A third azea of concern is the diversion ditch that has <br />been constructed above the shrub establishment area and elk fence. Further, aerial photos of the <br />azea of concern were taken on August 10`h and examined by Division staff. It is apparent from <br />site inspections and aerial photos, that the designed post-mine drainage density in the locations <br />described above is not adequate to safely convey the large amounts of runoff received in this azea <br />or to protect topsoil and vegetation from erosion. Please redesign and resubmit as a technical <br />revision to the PAP, the post-mine channel designs and configurations in the lower East Wadge <br />pit, dozer pit, and shrub establishment area. Please be sure to incorporate all channels that aze <br />intended to be permanent post-mine features including the new v-shaped channel west of PM-8, <br />and the diversion located above the elk fence and shrub establishment azea.
