Since the permit renewal proposed decision date of December 6, 2002, one Notice of Violation <br />was issued. NOV CV-2003-005 was written for failure to comply with permit conditions. <br />Topsoil redistribution and seeding was not conducted according to the approved reclamation <br />schedule. SCC failed to meet permit commitments for topsoil redistribution and failed to seed <br />and plant disturbed azeas during the first normal period for favorable planting conditions after <br />final preparation for seeding and planting. NOV CV-2003-005 was issued on June 17, 2003. <br />The NOV was abated by September 15, 2003 and was terminated on October 27, 2003. <br />SECTION II -REVISIONS TO THE PERMIT <br />The following is a summary of the revisions to the permit application package since the Permit <br />Renewal No. 4 Findings Document dated December 6, 2002. Since the last permit renewal there <br />has not been an increase in the bond amount required as a result of revisions to the permit. Prior <br />to this Midterm Review (MTS), the bond liability cost estimate was last updated with Permit <br />Renewal No. 4 (RN4). As described below reclamation costs estimates associated with <br />Technical Revision No. 35 were incorporated into the bond liability estimate completed for <br />RN4. <br />Technical Revision No. 35 was received by the Division on February 1, 2002, and deemed <br />complete on February 11, 2002. This revision application was in response to Adequacy <br />Comment 7 in the Division's October 22, 2001 letter regarding the application for permit <br />renewal RN4. This revision provided as-built drawings and certifications for existing stock <br />ponds and provided for the retention of twelve stock ponds as permanent features with a reduced <br />inspection frequency from quarterly to annual. The revision did not include a revised <br />reclamation cost estimate. Reclamation costs associated with both temporary and permanent <br />stock ponds were included in the reclamation cost estimate completed for Permit Renewal No. 4. <br />The revision application was approved on August 20, 2003. <br />Technical Revision No. 36 was received by the Division on June 14, 2004 and deemed complete <br />on June 17, 2004. This revision addresses changes/updates to select post mine channel designs, <br />the hydrologic monitoring plan, and to the Petroleum Contaminated Material stockpile location. <br />A revised reclamation cost estimate will be completed for this revision. This technical revision <br />is pending approval; the decision due date is currently August 16, 2004. <br />Minor Revision No. 52 was received by the Division on October 3, 2003. The minor revision <br />was deemed incomplete on October 7, 2003. This revision presented new designs for post mine <br />channels PM-9 and PM-17. SCC subsequently withdrew the revision and resubmitted the <br />designs as part of Technical Revision No. 36, which as indicated above is still pending approval. <br />SECTION III -STATUS OF STIPULATIONS <br />One stipulation remains in effect for the Seneca I[ Mine. This stipulation is being modified for <br />this midterm review to more accurately address the requirements for retaining permanent access <br />roads. <br />
