Collins, CO 80525 <br />Re: Timnath Pit, Revision Approval, Permit No. M-89-056, Revision No. <br />AM-001 <br />Dear Mr. Kehn: <br />On September 20, 1994 the Colorado Division of Minerals and Geology <br />conditionally approved the amendment application submitted to the <br />Division on February 7, 1994, addressing the addition of acreage and <br />revised mine plan. The terms oP amendment AM-001 approved by the <br />Division are hereby incorporated into Permit No. M-89-056. <br />The conditions of the Division's approval are noted below. Stipulation <br />No. 01 was a condition of original permit approval. Please note that <br />all other provisions of Permit No. M-89-056 remain in full force and <br />effect. <br />Stipulation No. O1 <br />NO MINING ACTIVITIES MAY OCCUR WITHIN 200 FEET OF ANY STRUCTURE <br />UNTIL THE APPROPRIATE AGREEMENTS ARE PROVIDED TO THE DIVISION OF <br />MINERALS AND GEOLOGY OR IT IS DEMONSTRATED, TO THE SATISFACTION OF <br />THE DIVISION OF MINERALS AND GEOLOGY, SY APPROPRIATE ENGINEERING <br />STUDIES, THAT THE MINING OPERATION COULD HAVE NO EFFECT ON THE <br />STP.$ILITY OF THE STRUCTURES. <br />Commitment No. O1 <br />THE: OPERATOR COMMITS TO INSTALLATION AND MONITORING OF THREE <br />GROUNDWATER TABLE MONITORING WELLS AS SPECIFIED IN THE PERMIT <br />DOCUMENTS. GROUNDWATER TABLE DATA AND PIT DE-WATERING <br />INFORMATION, ALONG WITH THE OPERATOR'S ANALYSIS OF THE DATA, WILL <br />BE PROVIDED TO THE DIVISION WITH EACH ANNUAL REPORT. <br />
