Cattany <br />Division Director <br />Na[urol Resource Trustee <br />During a recent review of the Timnath Pit file, the Division discovered stipulations that were placed on approval of the <br />original permit approval (Stipulation No. 1) and the amendment application (AM-Ol, Commitments No. Ol and 02). <br />Attached is a letter from the Division to Don Kehn Construction, Inc, regazding the conditions placed on approval of the <br />permit and AM-O 1 dated September 23, 1994. <br />The Division could find no evidence in our files that any of these stipulations have been complied with by Don Kehn <br />Construction, Inc. Please review the list of stipulations, and inform the Division as to their status. To avoid potential <br />future enforcement actions for non-compliance with State Statutes, Rules and Regulafions, and/or conditions specified <br />in your pemut for this site, documentation of compliance for each stipulation must be submitted to our office by <br />August 31, 2004. <br />If you have any questions, please contact me at (303) 866443. <br />Sinc <br />/Erica S.
