The Division found the application complete on October 10, 1995. On October 19, 1995, <br />Slurco submitted to the Division a copy of Slureo's letter to the adjoining landowner who <br />had not been previously notified. Submittal of the copy of Slurco's letter occurred within <br />the time frame required by Regulation 3.03.2(1)(a). <br />On October 10, 1995, at the same time the Division found this latest Phase II Bond Release <br />request complete,. the Division scheduled a bond release inspection for Tuesday, <br />October 24, 1995 at 1:30 p.m., in accordance with Regulation 3.03.2(2). The Division, on <br />October 10, 1995, notified the operator, surface landowners and the Denver Field Division <br />of the U.S. Office of Surface Mining of the time, date and location of the inspection. In <br />the case of the surface owners, the Division informed them of their option to participate in <br />the Division's inspection. <br />The Division conducted an analysis of the Area IV/Pond 3 vegetation data submitted in <br />Slurco's September 7, 1995 bond release application. On October 17, 1995, the Division <br />determined that the vegetation in Area IV/Pond 3 met the associated regulatory criteria for <br />Phase II Bond Release. <br />The Division conducted an inspection of Slurco's records filed with the Jackson County <br />Clerk and Recorder on October 24, 1995, prior to the on-the-ground site inspection. The <br />Division found that a copy of the latest Phase II Bond Release application was on file. The <br />Division reviewed the Jackson County property ownership records on the same day and <br />further determined that the surface owners notified by both Slurco and the Division of the <br />on-site inspection were those who owned the property within the Canadian Mine permit <br />area at the time of the inspection. The Division concluded that all current surface owners <br />were sent notification of both Slurco's bond release application and the Division's <br />October 24, 1995 bond release inspection. <br />The Division conducted its on-the-ground Canadian Mine bond release inspection on <br />October 24, 1995. Present were: Daniel I. Hernandez, Senior Environmental Protection <br />Specialist from the Division; Jim Perry, Natural Resource Specialist from the Kremmling <br />(Colorado) Resource Area office of the U.S. Bureau of Land Management; and Jerry <br />Koblitz, Permit Coordinator for Slurco Corporation. Representatives from the U.S. Office <br />of Surface Mining had earlier declined attending. The results of this inspection aze <br />provided below. <br />A copy of the Division's inspection report, dated October 24, 1995, was presented to the <br />operator at the site at the conclusion of the inspection that day, and made immediately <br />available for public inspection in the Division's offices, in accordance with Regulation <br />3.03.2(2). <br />II.
