I. Procedure for Seeking Bond Release and Summary of the Review Process <br />This document presents the results of the Division's review of Slurco Corporation's <br />(Slurco) request for Phase II Bond Release fora 57.19-acre portion of the disturbed area at <br />the Canadian Strip Mine. Slurco bas applied for bond release under Regulations 3.03.1(2) <br />and 3.03.1(3). <br />This Phase II Bond Release request follows an earlier Slurco Phase II Release request that <br />was submitted on March 1, 1990 and partially approved on November 13, 1991. <br />The Canadian Strip Mine is located 12 miles east of Walden, Colorado. The mine is <br />located in portioas of Sections 2, 10 and 11, Township 8 North, Range 78 West, 6th P.M., <br />in Jackson County, Colorado. All lands listed above may be located on the USGS <br />7.5 minute quadrangle map entitled Johnny Moore Mountain. <br />On Apol 18, 1995, the Division published its Guideline Regarding Selected Coal Mine <br />Bond Release Issues. Paragraph III.A. of Part 1 of the Guideline advises operators to <br />contact the Division prior to any vegetation sampling that the operator may conduct <br />associated with Phase II Bond Release, so as to allow the Division the opportunity to be <br />present during the sampling. Having the Division present during the sampling allows, <br />according to the Guideline, resolution of any uncertainties with regard to sampling <br />approaches or methods at that time. <br />On August 9, 1995, a representative from the Division met with representatives of Slurco at <br />the Canadian mine site to observe the vegetation sampling being conducted for Area IV <br />(55.13 acres) and reclaimed Pond 3 (2.06 acres). As documented in the Division's report <br />of that inspection and in subsequent Division correspondence, the Division determined the <br />vegetation sampling methodology being implemented by Slurco at that time to be <br />appropriate. <br />Slurco submitted its application for Phase II Bond Release on September 7, 1995. Copies <br />of the written notices to surface owners, adjoining owners and appropriate governmental <br />agencies required by Regulation 3.03.2(1) were provided in the submittal as recommended <br />in Regulation 3.03.2(1)(a). <br />The Division found the application incomplete on September 11, 1995 for lack of proof of <br />publication of the public notice required per Regulation 3.03.2(1)(b). The Division, at that <br />time, also informed Slurco of an additional adjoining surface owner who needed to be <br />notified of the application. Slurco subsequently mailed a notification to this remaining <br />adjoining surface owner regarding its application on September 13, 1995. <br />Public notice of Slurco's submittal occurred once per week for four weeks, during a period <br />between Thursday, September 7, 1995 and Thursday, September 28, 1995, th the Jackson <br />County Star, a newspaper of general circulation in the locality of the Canadian Strip Mine. <br />Publication of the notice occurred in accordance with Regulation 3.03.2(1)(b). Slurco <br />submitted proof of publication of the public notice to the Division on October 3, 1995, in <br />accordance with Regulation 3.03.2(1)(c). <br />
