XX. Roads - Rules 2.03 and 4.03. <br />A complete discussion of roads is found in Volume II, Tab 12 of the permit <br />renewal application and Volume VI, Tab 12 of the original permit application, <br />with references to associated maps and calculations. <br />The Seneca II Mine site will eventually contain about 16 miles of roads as the <br />mine expands into unmined areas. The design of haul roads has been based upon <br />the anticipated volume of traffic, weight and speed of the vehicles using them. <br />All culverts were designed to pass the 10 year, 24 hour design flow at <br />acceptable headwater conditions. Erosion control treatments at the outlet and <br />inlet free ends of culverts will be used and, as described, are acceptable <br />methods. All roadside ditches have been designed to safely pass design flows. <br />Peabody Coal Company has proposed to use alternate culvert spacing <br />specifications as per Rule 4.03.2(4)(c)(v). Peabody Coal Company contends, <br />and the Division concurs, that this practice will limit erosion at the mine <br />site. The Division finds that the design presented by Peabody Coal Company <br />will more effectively control and minimize erosion. Therefore, the Division <br />approves this variance. <br />A discussion pertaining to the 110 foot fill embankment on the main haul road <br />may be found in the original findings document (1981). Due to stability <br />concerns, annual certifications of this structure were required. As no <br />information has been submitted to the Division to warrant eliminating the <br />stipulation, the following stipulation remains in effect. <br />STIPULATION N0. 5 <br />THE 110 FOOT FILL EMBANKMENT ON THE MAIN HAUL ROAD MUST BE INSPECTED ANNUALLY, <br />OR WITHIN 10 DAYS FOLLOWING ANY STORM WHOSE BACKWATER ELEVATION EXCEEDS THE <br />ELEVATION OF 6941.1 FEET ABOVE SEA LEVEL (10-YEAR, 24-HOUR MAXIMUM STORM <br />EVENT'S PROJECTED BACKWATER ELEVATION) BY A QUALIFIED GEOTECHNICAL ENGINEER OR <br />ENGINEERING GEOLOGIST. A LETTER OF CERTIFICATION CONTAINING THE RESULTS MUST <br />BE SUBMITTED TO THE DIVISION WITHIN 2 WEEKS FOLLOWING THE INSPECTIONS. <br />With the continued acceptance of the above stipulation, the operation is in <br />compliance with the requirements of this section. <br />XXI. Bondin -Rule 2.05.4(2)(b), Rule 3 <br />Information pertaining to performance bonding and reclamation cost estimates <br />for the Seneca II Mine is presented in Volume II, Tab 13, Post-Mining Land <br />Use Plan, pages 13-39 to 13-63 of the permit renewal application.
