- 4 - <br />THE DIVISION IS SETTING THE FOLLOWING SPECIES DIVERSITY REVEGETATION <br />SUCCESS STANDARD: <br />SPECIES DIVERSITY WILL BE CONSIDERED ADEQUATE ON THE REVEGETATED <br />SAGEBRUSH COMMUNITY AREAS IF THE PERMITTEE HAS ESTABLISHED TWO <br />SPECIES OF COOL-SEASON BUNCH GRASSES, TWO SPECIES OF COOL-SEASON <br />SOD GRASSES, TWO SPECIES OF LEGUMINOUS FOR BS, AND TWO SPECIES OF <br />WOODY PLANTS; EACH SPECIES OF THE ABOVE BEING REPRESENTED BY NOT <br />LESS THAN 3% RELATIVE COVER OR MORE THAN 40% RELATIVE COVER ON <br />THE REVEGETATED SURFACE. <br />Stipulation No. 6 <br />THE DIVISION REQUIRES THAT STORM KING MINING COMPLETE AN AP PROVABLE <br />"DETAILED ENGINEERING PLAN" FOR THE PERMANENT PHASE B WASTE SLURRY <br />EMBANKMENT AND SUBMIT THE PLAN TO THE DIVISION ONE YEAR PRIOR TO THE <br />EXPIRATION DATE OF THIS PERMIT. THE DETAILED PLAN SHALL BE SUBMITTED <br />AS A PERMIT REVISION. FURTHER, IF 12,000 TONS OF WASTE IS PRODUCED <br />PRIOR TO OBTAINING APPROVAL OF THE PERMANENT WASTE EMBANKMENT, MINING <br />OPERATIONS SHALL CEASE UNTIL AN APPROVAL IS OBTAINED FOR PERMANENT <br />DISPOSAL OF ADDITIONAL WASTE. <br />Stipulation No. 7 <br />PRIOR TO CONSTRUCTION OF THE ACCESS ROAD, THE APPLICANT MUST SUBMIT <br />SITE SPECIFIC DESIGN STANDARDS FOR EMBANKMENT STABILITY, FOR DIVISION <br />APPROVAL. 7HE ANALYSIS SHALL BE CONDUCTED IN CONFORMANCE WITH RULE <br />4.03.1(3)(d)(vii). THE DESIGN STANDARDS SHALL BE SUBMITTED AS A <br />REVISION TO THE PERMIT APPLICATION. <br />Stipulation No. 8 <br />THE DIVISION REQUIRES THE PERMITTEE IN THE EVENT THAT SINKHOLE <br />SUBSIDENCE COLLAPSE WERE DETERMINED, BY THE DIVISION, TO CONSTITUTE A <br />POTENTIAL HAZARD TO THE PUBLIC HEALTH AND SAFETY, TO IMPLEMENT <br />APPROPRIATE SEALING AND BACKFILLING OF SINKHOLE COLLAPSE FEATURES. <br />Stipulation No. 9 <br />THE DIVISION REQUIRES THE PERMITTEE IN THE EVENT THAT ANY SLOPE <br />INSTABILITY IS DETERMINED BY THE DIVISION TO HAVE DEVELOPED WITHIN <br />THE AFFECTED AREA, TO SUBMIT TO THE DIVISION FOR REVIEW AN ANALYSIS <br />OF THE CAUSES AND RESULTANT HAZARDS OF ANY SUCH UNSTABLE SLOPE AREA. <br />USING THIS ANALYSIS, THE DIVISION SHALL DECIDE WHETHER A HAZARD IS <br />REPRESENTED BY ANY SPECIFIC SLOPE MOVEMENT EVENT AND WHETHER A SLOPE <br />STABILIZATION PROGRAM SHOULD BE DEVELOPED AND IMPLEMENTED. <br />
