Your attention is called to the following provision <br />from C.R.S. 34-32-124(7): <br />"Any person who violates any provision of any permit issued under this <br />article shall be Subject to a civil penalty of not less than one <br />hundred dollars per day nor more than one thousand dollars per day for <br />each day during which such violation coorus; except that any operator <br />who operates under a permit issued under section 34-32-110 shall be <br />subject to a civil penalty of not less than fifty dollars nor more than <br />two hundred dollars per day for each day during which such violation <br />occurs. <br />The Division has receivfad a report from your consultants Mr. Rindahl and Mr. <br />Rouse. The actions takE~n to determine possible environmental damage was <br />appropriate. The Division will further review this report. It should be <br />noted that the Board did not impose an emergency cease and desist order based <br />upon the assurance that Mined Development, Inc. would not be adding any <br />further cyanide or solution to the heap leach pad/pond site.
