Edward Brosseau .Jr. Mine Development Inc. 1288 County Road 205 Durango, CO 81301 RE: Neglected Mine, Bile No. 81-165 Notification of a Formal Public Hearing Dear Mr. Brosseau: Action by the Colorado Nlined Land Reclamation Board at their June 26, 1985 meeting resulted in a finding that there is reason to believe that a violation to the permit for the shove captioned operation has occurred (34-32-124(1), C.R.S.). This matter will be on the Board agenda as July 24-25, 1985, for consideration of the cease and desist order on this operation, the violation and civil penalty. Pursuant notified that a hearing has been scheduled Administrative Procedure Act" APA, article a Formal Public Hearing on possible violation and possible possible corrective actions(s) for to C.R.S. 34-32-124, you are hereby pursuant to the "State 4 of title 24, C.R.S. At the hearing, which will be held in Room 110 of 1313 Sherman Street, Denver, Colorado beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, you will hav~a the opportunity to be represented and heard. It will be reiterated that ,you have been in violation of the permit, specifically the following provisions: A cyanide solution spill occurred from the heap leach pad on to an unlined area. This is potentially a violation of Exhibit B and a technical revision to permit 81-165 and of C.R.S. 34-320116(1)(h) which states: "(h) Disturbances to the prevailing hydrologic balance of the affected land and of the surrounding area and to the quality and quantity of water in surface end ground water systems both during and after the mining operation a.nd during reclamation shall be minimized." 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
