The correspondence extends the free use permit from BLM for one more <br />year. Also referenced are possible changes in use of the site for a waste transfer station. The Division <br />would like to make sure the County understands that any changes that are contemplated either have to <br />match the approved Reclamation Plan or the plan must be changed to reflect site plans. Currently, the <br />Reclamation Plan calls for the site to be returned to rangeland. The Reclamation Plan may be changed <br />through an amendment to reflect proposed activities. The amendment process takes 90 to 120 days <br />normally to accomplish. The Division cannot release a site unless the site matches the Reclamation Plan. <br />Another issue is the fact that the Free-use permit issued by BLM is the Division's proof of right to <br />access. Should the County fail to fully reclaim the site by the date noted, it technically is a loss of <br />access, which is a violation of the Rules and Regulations. It would be in the County's, BLM's and <br />Division's best interest to address any changes sooner than later.
