In either case, if removal of these structures has not been previously re- <br />viewed by the Colorado Historical Society for compliance with all Federal <br />and State historic preservation laws, such review and subsequent approvals <br />must be obtained prior to the activity commencing. <br />Additionally, as removal of these stnrctures constitutes "active" mining per <br />Rule 1.04(4), no building removal activity may occur while the permit is in <br />"Temporary Cessation" status. <br />7. The next question dealt with the need to provide information, per <br />Rule 2.04.9,for the soils in the areas where the new bath house and shop <br />will be constructed. <br />Rule 2.04.9 states that this information is required, but may be extrapolated <br />from adjacent or similar areas of the same soil type, where the Division <br />determines, in its discretion, such extrapolation is appropriate. <br />We recommend you review the current Soils Resources section of the <br />permit, and incorporate the appropriate portion of this section into your new <br />submittals. <br />8. The next question dealt with clarification of the requirement for certification <br />of sediment pond inspections by a professional engineer. <br />This requirement is addressed in several references. Rule 4.05.6(13) states <br />that <br />"a!lsedimentation ponds shall be examined by a qualifted registeredprofession- <br />al engineer or other qualified individuals under their direcrion. The professional <br />engineer or individual shall be experienced in the construction of sedimentation <br />ponds...Theseinspections shall be made regularlyduring construction, and, at a <br />minimum, on a quarterly basis thereafter. The report shall be retained at or <br />near the mine site and a copy of the report promptly submitted to the Division <br />on a quarterly or annual basis, as required by the Division, by a registered <br />professional engineer. " <br />Additionally, Rule 4.05.9(13) states that <br />"all impoundments shall be examined to assure appropriate maintenance of the <br />structure and for structural weabtess, erosion and other hazardous conditions <br />by a qualified registered professional engineerora qualified individual under <br />their direction...Theinspections shall be made regu/arlyduring construction, <br />upon completion of construction and, at a minimum, quarterly thereafter, with <br />the repon retained at or near the mine site. A copy of the report shall be <br />submiteed ro the Division on an annual basis by a registeredprofessional <br />engineer. " <br />
