Since I am the <br />consultant that works.-with Mr. McKay, Lakewood Brick and Tile, <br />Company"and Centennial Aggregates, LLC. on these mines,.I have <br />been asked to respond to-your correspondence. I apologize.-for <br />the long delay in doing this reply. <br />All the parties involved are aware that Department of Energy <br />and the U.S. Fish and Wildlife Service are/or will be the primary <br />surface owners of the site and the activities taking place there <br />on. Over the years your agency has been contacted each and every <br />time a change to the Reclamation Plan has been made or proposed. <br />During Mr. Schiesswohl's era that toas easy to do and we met with <br />him regularly. As you pointed out this is required in Colorado <br />Law which we have and will continue to observe. In all cases <br />that i recall, we contacted the DOE prior to submitting the <br />change in writing, so the agency's input could be incorporated <br />with our submittal to the state. We .look forward to this contin- <br />ued cooperation that benefits all parties. <br />However, the one problem i have is that DOE does not keep <br />their address current in the .Jefferson County land ownership <br />records (assessors office). As you may be aware, Colorado Mined <br />Land Reclamation Board regulations require a mine operator to <br />contact the "owner of record" when changes are made. The "re- <br />cord" is from the local assessors office and if the address we <br />find in the "record" is incorrect then we ,have no way: of ,know: <br />this until the certified notice is returned. In December 2004 <br />when the last change was made the owners address for the property <br />as listed in the Jefferson County Assessor's office was: United <br />States of America, Department of Energy, USPO Box 6.014, Omaha, NB <br />68102.
