Management coal leases were successfully reassigned from Bowie <br />Resources Limited to Bowie Resources, LLC. <br />6. The DMG hereby finds that the Personal Injury and Property Damage Insurance <br />Information required by Rule 2.03.9 has been properly submitted, reviewed and deemed <br />adequate (2.08.6(2)(b)(iii)). <br />7. The DMG hereby finds that the Identification of Other Licenses and Permits required by <br />Rule 2.03.10 has been properly submitted, reviewed and deemed adequate <br />(2.08.6(2)(b)(iii)). <br />8. Pursuant to Rules 2.07.6(1)(b) and 2.07.6(1)(c), the Applicant Violator System (AVS) <br />evaluations were conducted by the DMG on January 22, 2004 and September 24, 2004. <br />The September 24, 2004 evaluation resulted in the AVS system showing an unpaid civil <br />penalty in Kentucky linked to John C. Smith, a controller for the DMG Permit No. C- <br />1981-038. The DMG is attaching the following stipulation to the succession proposed <br />decision. <br />The permit transfer from Bowie Resources Limited to Bowie Resources, <br />LLC is conditioned upon resolution of Kentucky Unpaid Civil Penalty for <br />Violation No. 5301 Sl associated with Kentucky Permit No. 8980503. <br />Proof of Resolution should be submitted to the Division of Minerals and <br />Geology as soon as it becomes available. <br />9. The DMG hereby finds that the succession application demonstrates compliance with <br />Rule 2.07.6(2) (2.08.6(4)(a)). <br />10. The DMG hereby fmds that, based upon representations by Bowie Resources, LLC, <br />Bowie Resources, LLC will conduct the operations in full compliance with the terms and <br />conditions of the original permit and in accordance with the requirements of the Act and <br />Rules (2,08.6(4)(c)). <br />Decision <br />The DMG hereby proposes to approve with stipulations the Request for Transfer of Coal Permit <br />and Succession of Operators for Permit No. C-1996-083, from Bowie Resources Limited to <br />Bowie Resources, LLC. <br />Any person with an interest, which is or may be adversely affected by this proposed decision, <br />may request a formal hearing on the proposed decision by the DMG. Such requests shall be in <br />writing and state with reasonable specificity the reasons for the request and objections to the <br />proposed decision. If so requested, the formal hearing shall be conducted in accordance with the <br />requirements of 2.07.4(3). The request for hearing must be received no later than 30 days after <br />the proposed decision date of September 28, 2004. Such requests shall be sent to the Colorado <br />Division of Minerals and Geology, 1313 Sherman Street, Room 2I ~, Denver, Colorado 80203. <br />
