This document contains the findings and proposed decision pertaining to a Request for Transfer
of Coal Permit and Succession of Operators {succession). The Division of Minerals and
Geology (DMG) received the succession application on December 31, 2003. The succession
application proposes a transfer of DMG Permit No. C-1996-083 from the current permittee and
operator, which is Bowie Resources Limited, to a new permittee and operator, Bowie Resources,
LLC. The application was submitted and reviewed pursuant to the procedures of Rule 2.08.6 of
the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining. The DMG
hereby proposes to approve, with stipulations, the succession request.
Process
On December 31, 2003, the above-referenced succession application was received at the offices
of the DMG.
Findines
The DMG hereby finds that a properly executed Request For Transfer of Coal Permit and
Succession of Operators application form has been submitted to the DMG, and this form
requests that the DMG Pennit No. C-1996-083 is transferred from Bowie Resources
Limited to Bowie Resources, LLC (2.08.6(2)(6)).
2. The DMG hereby fords that a properly executed Surface Coal Mining and Reclamation
Operations Reclamation Bond of $7,868,298.00, in the form of Corporate Surety Nos.
for the amount of $1,975,000.00, for the amount
of $425,000.00, in the amount of $45,000.00,
for the amount of $2,500,000.00, for the amount of
$2,500,000.00, for the amount of $325,115.00 and
for the amount of $98,183.00 has been submitted by Bowie Resources, LLC, for
Permit No. C-1996-083, and the bond has been accepted by DMG (2.08.6(2)(a) and
2.08.4(4)(6)).
The DMG hereby finds that the Identification of Interests information required by Rule
2.03.4 has been properly submitted, reviewed and deemed adequate (2.08.6(2)(b)(iii)).
4. The DMG hereby fords that the Compliance Information required by Rule 2.03.5 has
been properly submitted, reviewed and deemed adequate (2.08.6(2)(b)(iii)).
5. The DMG hereby finds that the Right of Entry and Operation Information required by
Rule 2.03.6 has been properly submitted and reviewed (2.08.6(2)(b)(iii)). The following
stipulation is attached to the Transfer of Permit and Succession of Operator proposed
decision to address an outstanding issue with the Bureau of Land Management Lease
Assignments.
The approval of Succession of Operator No. 2 is conditioned upon the
submittal to the Division, within 90 days of the date of the proposed
