Annual Reports. Applicant shall submit to the Tiller Counn Planning Department a copy <br />of each annual report required to be submitted to the Colorado Division of Minerals and <br />Geology. Failure to submit to Teller County one or more copies of such reports shall be <br />considered grounds for revocation of this Conditional Use Permit. <br />2. USFS Plans of Operation. Applicant shall submit to the Tiller County Planning <br />Department a copy of the approved 2006 Plan of Operations for Mining Activities on <br />National Forest System Lands, and am' subsequent or amended Plan, as well as each Decision <br />Memo or letter of approval issued by the U.S. Forest Service. Failure to submit one or more <br />copies of such Plans, Memos, or letters to Teller County shall be considered grounds for <br />revocation of this Conditional Use Permit. <br />3. USFS and DMG Conditions Apph. All conditions of approval placed by the U.S. Forest <br />Service on any Plan of Operations for Mining Activities on National Forest System Lands (or <br />any amendment thereto) covering Colorado Calumet claims, or as set forth in any letter of <br />approval, shall be conditions of this Conditional Use Permit. All conditions of approval <br />placed by the State of Colorado on any Division of Minerals and Geology permit issued (or <br />any amendment thereto) shall likewise be conditions of this Conditional Use Permit. <br />4. Blasting. At such time, if ever, as Applicant or its Operator shall submit to the State of <br />Colorado an application for a permit for blasting or use of explosives on Colorado Calumet <br />claims, a copy of such permit, together with the response of the State of Colorado, shall be <br />submitted to the Teller County Planning Department. <br />5. Suspension /Revocation. This Conditional Use Permit shall be automatically suspended <br />upon revocation or termination of any approved Plan of Operations for Mining Activities on <br />National Forest System Lands (or any amendment thereto), or other approval issued by the <br />U.S. Forest Service covering Colorado Calumet claims. Likewise, this Conditional Use <br />Permit shall be automatically suspended upon revocation of any Division of Minerals and <br />Geology mined land reclamation or other permit issued by the State of Colorado. This <br />Conditional Use Permit may be revoked pursuant to the procedures and requirements of the <br />Teller County Land Use Regulations in effect at the time. <br />6. Expiration and Extension. This Conditional Use Permit shall expire on December 31, <br />2016, but may be Administratively extended provided that Applicant has an approved and <br />current Forest Service Plan of Operations extending beyond this date and an approved and <br />current State of Colorado Division of Linerals and Geology mined land reclamation permit. <br />7. Administrative Approvals. Upon review of any proposed or effected change to a Forest <br />Service Plan of Operations covering Colorado Calumet claims, or DMG Mined Land <br />Reclamation permit, this Conditional Use Permit may, at the sole discretion of the Director of <br />Community Development Services, depending on [he extent and nature of the change and in <br />consideration of any recommendation by the U.S. Forest Service, be modified <br />administratively by the Director of Community Development Services in writing and for <br />reasons given. Substantive change may require a formal amendment of this Conditional Use <br />Permit by the Board of County Commissioners, with recommendation from the Planning <br />Commission.
