<br />Prior to any disturbance in the West Pit mining area, Colowyo Coal <br />Company must post an additional 84,117,250.00 performance bond with the <br />Division. <br />11. The Division has made a negative determination for the presence of prime <br />farmland within the permit area. The decision was based on a letter from <br />the Soil Conservation Service that demonstrates that no prime farmland <br />mapping units are found within the permit area. This letter is dated <br />December 18, 1980 and can be found in Exhibit 9 of the permit application <br />(2.07.6(2>(k)). <br />12. Based on information provided in the application, the Division has <br />determined that alluvial valley floors exist within the permit or <br />adjacent areas. These alluvial valley floors are known as Goodspring <br />Creek, Wilson Creek and Lower Elkhorn Creek. Goodspring Creek and Wilson <br />Creek will be potentially affected by mining operations (2.07.6(2) and <br />2.06.8(3)(C>). <br />For additional specific findings concerning this alluvial valley floor <br />please see Section B, Item XVII of this document. <br />13. The Division hereby approves the post-mining land use of the operation. <br />It was determined that range and wildlife use meets the requirements of <br />Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals <br />are addressed in Section B of this document (2.07.6(Z>(m)). <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, June 10, 1992, the operator is current in the <br />payment of reclamation fees required by 30 CFR Chapter VII, subchapter R. <br />(2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4: <br />I. ROADS - SPECIFIC FINDINGS FOR RULE 4.03 <br />Information on roads is presented on pages 2.05-20 through 2.05-21, <br />Section 4.03, and Map 25 of the permit application. Three types of roads <br />are described in the permit application: haul roads, access roads and <br />light-use roads. <br />_lq_ <br />
